Council Action Requested:

This Ordinance is a companion Ordinance to Ordinance 2022-1825. 

 

In October of 2020, Council approved the petition of Lennar Carolinas, LLC, ("Lennar") to create the Roselyn Residential Improvement District (RID) via Resolution 1117-R2020. Then in December of 2020, Council authorized the creation of the Roselyn RID, implementation of the Improvement Plan, the finance of improvements within the district, the issuance of bonds, and approved the assessment roll via Ordinance 2020-1691. 

 

However, Lennar Carolinas, LLC, the primary land owner within the District, has advised the County that, after the District was created and efforts were made to combine most of the original parcels into a single parcel, it was discovered that a portion of the original parcels actually consisted of land owned by an adjacent landowner. These "excluded parcels" were not intended to remain within the District.

 



Points to Consider:

Lennar has requested that the County modify the District to remove the Excluded Parcels from the District and amend the Ordinance and the Assessment Documents to reflect the corrected parcels. Lennar has stated that the District should be comprised of the parcels described in Exhibit A to this Ordinance. Lennar has provided written consent and a waiver with respect to this modification.

 

The changes would reduce the original district size by approximately 50.677 acres to a new total of 1,395.829 acres.



Funding and Liability Factors:

The property modification does not change the funding and liability factors for the project.



Recommendation:

Approve the Ordinance.
