Council Action Requested:

Application by Nathan Terry to rezone a .488-acre parcel located at the northern intersection of Charles Pettus Road and Charlotte Hwy (portion of TM# 0016-00-046.00) from Low Density Residential (LDR) to Professional Business (PB) in order to build a medical office.



Points to Consider:

The north side of the subject property directly fronts U.S. 521 while the west and south side of the parcel are surrounded by Charles Pettus Road. Access to this site is planned to be provided from Charles Pettus Road. 

 

This project falls under the Southern Panhandle Small Area Plan. This plan supplements the Comprehensive Plan as the long-range guide for future growth and community development. A goal for the Southern Small Area Plan is: “....focus(ing) long term economic development at the northernmost portion of the project boundary and also near the intersection of US-521 and the southern segment of Charles Pettus Road.” The proposed zoning of Professional Business would be consistent with the Southern Panhandle Small Area Plan and nearby zoning.

 

The project will need to provide cross access to the adjacent parcels via stub outs and sidewalks. The proposed 2,500-3,000 Sq. Ft. chiropractic office would not trigger a Traffic Impact Analysis (TIA). 

 

The applicant does have water access from both US 521 and Charles Pettus. The possibility of septic is currently being perused by the applicant. The Lancaster County Water and Sewer District are not opposed to an onsite septic system and the applicant currently has a permit to construct from South Carolina Department of Health and Environmental Control (SCDHEC).

Recommendation:

Planning Commission recommend unanimous approval at their November 2022 regular meeting. At the meeting, Commissioners discussed frontage sidewalk requirements along US 521.

 

Staff also recommended approval.
