Application by Richard F. Duncan to rezone approximately 1.206 acres, located at 3867 Pageland Highway (p/o TM 0059-00-058.00) from Rural Residential (RR) to Rural Business (RUB) district, in order to remedy non-conformity of existing business on site and allow minor subdivision of property.
Points to Consider:
Richard F. Duncan has operated his business, the Duncan Auto Service LLC on the same parcel of land that his residence is located on off Pageland Highway since at least the early 1990's. When he wanted to divide his business from his home, he didn't realize that his business was a nonconforming use. He wanted to resolve this issue since he is getting close to retirement and may want to sell the business.
Funding and Liability Factors:
The ordinance would remove the auto service nonconformity, allowing Mr. Duncan to continue to operate his business and, if needed, repair it after a storm.
Recommendation:
The Planning Commission recommended unanimous approval of the proposed rezoning during their April meeting.
Staff also recommends approval.
