Council Action Requested:

Application by C4 OP Owner LLC to rezone approximately 28.01 acres at and adjacent to 8918 Charlotte Highway (TM # 0010-00-029.00) from Light Industrial (LI) to Regional Business (RB) district, in order to develop a retail facility with ancillary gas station.

The rezoning is proposing to rezone a 28.01 acre site from Light Industrial (LI) to Regional Business (RB). This land was set aside from a nearby mixed uses project called The Exchange.

 

The Exchange has as associated Development Agreement that categorized this 28.01-acre parcel of land be categorized as "Economic Development Property". According to the Development Agreement, this land must remain zoned Light Industrial and have additional use restrictions unless the County and developer agree on a new zoning district. This must be a written document that is signed by the County and developer. This document has not be achieved yet but we believe that it is achievable before Third Reading of County Council.

Recommendation:

The rezoning was recommended approval at the May Planning Commission meeting with a vote of 5-1. There was a discussion regarding the change in land use from Light Industrial to Regional Business.

 

Staff also recommends approval.
